Terms of Service

Effective: January 21, 2026

These Terms of Service (“Terms”) govern your access to and use of Flutus Q Voice (the “Service”). By creating an account, subscribing, or using the Service, you agree to these Terms.

1) Who we are

Flutus Q Voice is operated by Sphari LLC (“Sphari”, “Flutus”, “we”, “us”).

2) The Service

Q Voice is an AI phone assistant designed to help you handle communications and workflows, including:

  • Answering calls as your assistant
  • Summarizing calls/messages and capturing key details
  • Routing requests and organizing follow-ups
  • Receiving voice requests (including orders/instructions) and generating supported actions
  • Integrating Voice + Chat so conversations can continue intelligently across modes
Intelligent Dynamic Architecture (IDs + Intelligent Dynamic System)

Q Voice uses an Intelligent Dynamic System designed around unique IDs (such as account IDs, device/session IDs, and/or phone routing identifiers) to help route communications, preserve context, and connect voice interactions to chat-based workflows.

Feature availability

Features may change over time and may depend on compatible devices, carriers, networks, and third-party providers. We may add, modify, suspend, or discontinue any part of the Service at any time.

3) Eligibility

You must be able to form a legally binding contract where you live to use the Service. If you use the Service on behalf of an organization, you represent you have authority to bind that organization to these Terms.

4) Accounts

You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activity under your account
  • Keeping your account information accurate and current

Notify us immediately at supp@sphari.info if you suspect unauthorized access or misuse.

5) Billing & subscriptions

If you purchase a paid plan:

  • Plans are billed in advance on a recurring basis (monthly or annual) unless stated otherwise
  • Payments are processed through Stripe
  • By subscribing, you authorize recurring charges until you cancel
Cancellation
  • Cancel anytime through your account (if available) or by contacting supp@sphari.info
  • Access remains active until the end of the current billing period
  • Taxes may apply depending on your location

6) Refunds (Fair Use / Half-Half Policy)

Unless required by law, payments are generally non-refundable. However, we aim to resolve issues fairly.

A) If we made a mistake (billing or service error)

If you believe there was an incorrect charge (for example, duplicate charge, wrong plan, billing malfunction), contact supp@sphari.info. If we confirm an error, we will correct it, which may include a full refund or adjustment.

B) Courtesy refunds (50% policy)

If you request a refund for reasons other than a confirmed error, we may offer a 50% courtesy refund for the most recent charge when reasonable, based on factors such as timing, usage, and account history. Courtesy refunds are evaluated case-by-case and are not guaranteed.

Typical response time: within 24 hours.

7) Acceptable use

You agree to use the Service responsibly and in compliance with all applicable laws, regulations, and third-party rules (including carrier policies). You must not use the Service to create, promote, facilitate, or engage in any activity that is unlawful, harmful, abusive, deceptive, invasive, or unsafe, including (but not limited to):

  • Fraud, deception, or misrepresentation, including scams, phishing, impersonation, identity misuse, or attempts to mislead others
  • Harm to others, including harassment, threats, intimidation, stalking, hateful or discriminatory conduct, or behavior intended to cause physical, emotional, reputational, or financial harm
  • Illegal or unsafe communications, including unlawful robocalls, unlawful mass messaging, or any communications that violate consent requirements
  • Privacy violations, including unlawful monitoring, recording, interception, or collection of personal data without proper notice, consent, and legal authority
  • Unauthorized access or interference, including attempts to access accounts, systems, networks, or data without permission; probing, scanning, exploiting vulnerabilities; or disrupting the Service
  • Malicious or harmful content, including malware, viruses, or instructions intended to damage systems or bypass security protections
  • Any activity that violates applicable laws, including laws related to telecommunications, consumer protection, recording consent, data protection, or anti-spam rules
Enforcement

We may investigate suspected violations and may remove content, limit functionality, suspend, or terminate access to the Service if we reasonably believe your use violates these Terms, creates risk or harm, or exposes the Service or others to legal or security risk. We may also cooperate with lawful requests from authorities.

8) Privacy

Our Privacy Policy explains how we collect, use, and protect information. Please review it before using the Service. (“Privacy Policy” link/section should appear on this page or in your app.)

9) International availability and compliance

The Service may be available through app marketplaces (including Google Play) and may be accessed from many countries. You are responsible for ensuring that your use of the Service is lawful in your jurisdiction, including compliance with local telecommunications rules, call recording/consent laws, data protection requirements, and any restrictions on automated calling or messaging.

If any part of the Service is prohibited or restricted by law where you live, you must not use the Service in that way. We do not represent that the Service is appropriate, permitted, or available for use in every location.

10) Disclaimers

The Service is provided “as is” and “as available.” To the maximum extent permitted by law, we make no warranties or guarantees of any kind—express or implied—including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

No guarantees

We do not guarantee:

  • Continuous, uninterrupted, timely, or secure operation or availability
  • That calls, messages, transcripts, routing, summaries, or actions will always be delivered, completed, or recorded correctly
  • Perfect accuracy of any AI-generated output, including summaries, classifications, recommendations, or interpretations
  • Compatibility with every device, carrier, network, region, operating system, or third-party provider
  • That the Service will be error-free, free of delays, or free of outages caused by carriers, networks, device limitations, third-party providers, or maintenance
AI limitations
  • Q Voice uses AI models and automated systems. AI can make mistakes, including misunderstandings, omissions, inaccurate summaries, incorrect classifications, or unintended outputs.
  • AI outputs may be incomplete, outdated, or wrong.
  • AI behavior may vary based on audio quality, background noise, accents, network conditions, and technical limitations.
  • The technology is evolving, and performance can change over time.

Any errors or unexpected outputs are not intentional. The Service is designed to operate in good faith and in alignment with applicable laws and policies, but it is not perfect and should not be treated as infallible.

Not professional advice

The Service does not provide legal, medical, financial, or other professional advice. You are responsible for verifying important information and decisions before acting. Do not rely on the Service for emergencies or time-critical situations where failure could cause harm.

Problems or concerns

If you experience an issue, suspect an error, or believe something is not working correctly, contact supp@sphari.info. We will do our best to assist and investigate.

11) Limitation of liability

To the maximum extent permitted by law, Sphari LLC and its affiliates, officers, employees, and partners will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service.

12) Changes to these Terms

We may update these Terms from time to time. If we do, we will revise the Effective date above. Continued use of the Service after changes means you accept the updated Terms.
